#1 MEDICAL DIAGNOSIS OF A DISEASE, DISABILITY OR CONDITION

You must have a Medical Diagnosis!

The common misconception is that people believe that the medical diagnosis of your disability or condition MUST be in your military service records.

This is a MYTH!

Your disabilities or conditions DO NOT need to be in your military service records!

It is military culture to "SUCK IT UP" and push on!

The last thing you want to do is go to medical and risk being ridiculed by your peers and superiors.

The problem with this is that once you leave active duty and apply for VA Disability Benefits, your claim gets denied.

You might see in your award letter, "Not Service Connected."

This means that you don't have any records of the injuries or conditions in your service treatment records, and the VA has denied your claim because of it.

It isn't because they don't believe you, but instead, you don't have the evidence required to back up your claim.

So, what this means is that you MUST get your butt to the doctor and get a diagnosis!

#2 NO CLEAR NEXUS - YOUR DISABILITY OR CONDITION WAS CAUSED OR MADE WORSE BY YOUR ACTIVE DUTY SERVICE

To be eligible for VA Disability Benefits under the law, a disability you suffer from today must have been caused or made worse by your active duty service or by another Service-Connected disability rated at 0% or higher.

If you have a Medical Diagnosis, but still receive a "Not Service Connected" in the VA Decision Letter, it is because the VA Rater and the Compensation & Pension Examiner has determined that you do not have a Clear VA Nexus.

The Nexus is needed to establish Service Connection on an AT LEAST AS LIKELY AS NOT basis.

The Nexus is the connection or link between your active duty service and your current disability or condition.

To establish an at least as likely as not basis, your service connected disability must have been caused or made worse by your active duty service is to get a Buddy Letter.

A Buddy Letter is a statement from a competent and credible first-hand witness such as a spouse, someone you served with, coworkers, etc.

Another thing you can do to overcome a denial of Service Connection is to acquire a competent and credible Nexus Letter from an independent medical professional.

In these Nexus Letters, the Independent Medical Provider will, in their opinion, describe how your condition was caused or made worse by your active duty service.

They will do this by citing relevant Medical Research, VA Case Law Precedent, and thoroughly combing through your medical records.

#3 SEVERITY OF SYMPTOMS

The VA Rates your conditions or injuries based on their severity.

A common thing we see among Veterans is that they fail to speak up about the severity of their symptoms!

Now, you should NEVER lie or stretch the truth to get a rating that you DO NOT deserve.

This is against federal law, and there are severe repercussions for doing so.

But, you must be open, honest, and truthful about your symptoms because your rating will be affected if you aren't!
